Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ClawBlitz platform, including our website, APIs, and managed OpenClaw hosting services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

ClawBlitz ("we," "our," or "us") reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

1. Service Description

ClawBlitz provides a managed hosting platform for OpenClaw, an open-source AI chatbot framework. Our Service includes:

• One-click deployment of OpenClaw instances
• Automated scaling, updates, and maintenance
• 24/7 monitoring and uptime management
• Integration support for platforms including Discord, Telegram, WhatsApp, and others
• Dashboard for managing deployments, configurations, and billing
• Encrypted secrets management for API keys and bot tokens

ClawBlitz is a hosting and infrastructure provider. We are not the developer of OpenClaw and are not responsible for the functionality, accuracy, or output of OpenClaw itself. OpenClaw is licensed under its own open-source license.

2. Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

3. Subscriptions and Payments

Billing

ClawBlitz offers subscription-based plans billed on a monthly or annual basis. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.

Payment Processing

All payments are processed securely through Stripe. By providing payment information, you agree to Stripe's Terms of Service.

Price Changes

We reserve the right to modify our pricing. Price changes for existing subscriptions will take effect at the start of the next billing cycle. We will provide at least 30 days' notice before any price increase.

Refunds

Subscription fees are generally non-refundable. However, if you experience a significant, unresolved service disruption caused by us, you may request a prorated refund by contacting [email protected].

Cancellation

You may cancel your subscription at any time through your dashboard. Upon cancellation:

• Your subscription remains active until the end of the current billing period
• Your deployments will be terminated at the end of the billing period
• You can export your configuration data before the subscription ends

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Distribute malware, viruses, or other harmful code
• Engage in unauthorized access to systems, networks, or data
• Send spam, unsolicited messages, or engage in phishing
• Deploy bots that harass, threaten, or abuse others
• Generate or distribute illegal, harmful, or abusive content
• Mine cryptocurrency or run compute-intensive workloads unrelated to OpenClaw
• Circumvent usage limits, rate limits, or resource quotas
• Resell, sublicense, or redistribute the Service without authorization
• Attempt to reverse-engineer, decompile, or extract source code from our proprietary systems

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. Your Data

Ownership

You retain ownership of all data you upload to or generate through the Service, including deployment configurations, bot settings, and custom prompts. ClawBlitz does not claim ownership over your data.

License Grant

By using the Service, you grant ClawBlitz a limited, non-exclusive license to store, process, and transmit your data solely for the purpose of providing and improving the Service.

Data Protection

Data Portability

You may export your deployment configurations and data at any time through the dashboard or by contacting support.

6. Service Availability

We strive to maintain high availability for all deployments. However:

• We do not guarantee 100% uptime
• Scheduled maintenance windows will be communicated in advance
• We are not responsible for downtime caused by third-party services (e.g., Discord, Telegram, OpenAI API outages)
• Force majeure events are excluded from any uptime commitments

7. Intellectual Property

The ClawBlitz name, logo, branding, website design, and proprietary platform code are the intellectual property of ClawBlitz. You may not use our trademarks without prior written consent.

OpenClaw is an open-source project with its own licensing terms. Your use of OpenClaw through our platform is subject to both these Terms and the OpenClaw license.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAWBLITZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or the Service shall not exceed the total fees you paid to ClawBlitz in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components. We do not guarantee the accuracy, reliability, or completeness of any content generated by OpenClaw instances deployed through our platform.

10. Termination

By You

You may terminate your account at any time by canceling your subscription and requesting account deletion through the dashboard or by emailing [email protected].

By Us

We may suspend or terminate your account at any time if:

• You violate these Terms or the Acceptable Use Policy
• Your payment method fails and is not updated within 7 days
• We are required to do so by law
• We discontinue the Service (with at least 90 days' notice)

Effect of Termination

Upon termination, your right to access the Service ceases immediately. We will delete your deployment data within 30 days unless retention is required by law. Sections that by their nature should survive termination (including Limitation of Liability, Disclaimer, and Governing Law) will survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, unless otherwise required by applicable law.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
